HASBRO CASE
Judgment Allows Release of Super Add-Ons™ In Time For Holiday Season
PETERBOROUGH, NH, April 7, 2005 — RADGames, Inc. announced today that it has received a favorable decision on the motion for a preliminary injunction filed by Hasbro, Inc. (NYSE: HAS) in Hasbro's litigation against the Peterborough, New Hampshire-based company. In its complaint, Hasbro alleged trademark and copyright infringement against RADGames, who had introduced a new board game - Super Add-Ons™ - at The American International Toy Fair in New York City this past February.
The United States District Court for the Southern District of New York ruled in favor of RADGames, refusing to enter a Preliminary Injunction and lifting the Temporary Restraining Order, allowing RADGames to resume production of its Super Add-Ons™ game compatible with Hasbro's Monopoly® game. Through its decision, the Court determined that Hasbro did not prove it had a likelihood of success on the merits of the case if it goes to trial.
"RADgames has added a new, original creation to the market which is designed for use with the plaintiff's product but is distinctive in its own right," ruled United States District Court Judge Hon. Gerard E. Lynch.
"We are extremely pleased with the decision of the Court," RADGames spokeswoman Ann Wilkins said. "Our Super Add-Ons™ game was extremely well-received at Toy Fair and we are anxious to start up our business operations again so we can bring the game to market in time for the holiday season."
A patented game-within-a-game concept for existing board games, Super Add-Ons™ are the brainchild of company founder Robert Wilkins who, as a 12-year-old in 1974, became frustrated when he couldn’t avoid paying costly rents as he passed by his opponents’ strings of houses and hotels in Monopoly®. Another way around the properties needed to be created. Thirty years later, Wilkins brought the first Super Add-Ons product to market — Super Add-Ons™ - Version for Monopoly®. Placed inside Hasbro's real estate trading game, the patented Super Add-Ons™ game offers a new level of play and excitement by providing additional properties, utilities and action cards.
RADGames holds two patents on the game, including one for its revolutionary "board within a board" concept. RADGames expects the "Super Add-Ons™" game to be available in select toy stores and gift shops this upcoming holiday season. Two additional games are currently under development.
